Premises and acceptance of the general conditions of sale
These general terms and conditions (hereinafter also General Conditions) govern the offer by Podere San Cristoforo s.s. agricola (from now on also Podere San Cristoforo) of products on www.PodereSanCristoforo.it (henceforth also Site).
The General Conditions must be accepted by the User when registering on the Site, in order to be able to take advantage of the offers made therein and to proceed with the purchase of products.
Podere San Cristoforo reserves the right to modify the General Conditions at any time, in whole or in part, notifying Users via the Site with at least 30 days’ notice, if the methods of use of the products and services offered have changed. Users are therefore required to periodically consult this page, in order to be always informed about the conditions applied. It is understood that the use of the Site following these changes implies the tacit acceptance of the same.
Ownership of the site – Type of offers
The site is owned by the Podere San Cristoforo s.s. agricola, with head-office in Vicenza, Strada Marosticana 6/8, C.F. e P.IVA 03836450241.
The range of products is related to the alcoholic and accessory categories (wines, sparkling wines, packaged products such as sauces, honey, olive oil and other food products and accessories for preparation , consumption or conservation of food) .
Following a purchase transaction, Podere San Cristoforo will issue to the User an order confirmation.
Sign in to the site
The Site is intended only for Users who are 18 years of age or older, and therefore, at the time of purchase only, they will be asked to confirm their age.
The User at the time of purchase, releases his/her personal data that will be used by Podere San Cristoforo for sales-related operations and to keep the customer informed about potential commercial offers. At any time the User can update and / or modify or request the cancellation of information released during the purchase. In the event of a cancellation request, however, Podere San Cristoforo may temporarily maintain, in whole or in part, such information, only for the purpose of executing any purchases made and / or being able to complete accounting and tax procedures.
Condition of the offer
The subject of Podere San Cristoforo’ offers is the purchase of goods at the prices indicated on the Website at www.PodereSanCristoforo.it.
Podere San Cristoforo reserves the right not to follow orders from subjects other than the “consumer” in accordance with its commercial policy. In any case, Podere San Cristoforo does not sell alcohol to individuals who are under the age of 18 or the age required by law in terms of consumption and purchase of alcohol in the country of residence. By sending an order, the consumer guarantees that the ordering party and, if it is different, the recipient of the goods are both aged over 18 years or in any case older than the minimum legal requirements in force in the country of residence and/or destination of the goods .
Prices are quoted in Euros and are inclusive of VAT . The shipping costs of goods may be fixed or variable, calculated on the basis of weight, number of items selected and/or the destination address of the goods. The user is always informed of the amount of shipping costs before concluding the purchase procedure and make the payment.
The images accompanying the information sheets of a product or offer may not be fully representative of its characteristics but may differ in color, size and accessory products in the figure. All the information supporting the purchase is intended as a simple general information material, therefore not referable to the real characteristics of a single offer.
The validity of offers may be subject to quantitative or temporal limitations, after which they may no longer be available. The validity date and/or the available quantity of the offers are shown on the Website in order to allow the User to become aware of it.
In some cases it is possible that the availability of an asset ends after the purchase: in these cases Podere San Cristoforo, if the conditions are met, will reimburse the User or will propose a variant of equal value at User’s discretion.
Purchase procedure and payment methods
Having acknowledged the conditions of the offer, the User may conclude the purchase by following the procedure on the Site.
Before the finalization of the purchase, a summary will be displayed in which the unit cost of the selected asset will be indicated and the total, in case of purchase of more quantities of the same article or of different articles. The cost of shipping, delivery or postal costs may be fixed or variable, calculated based on the weight of the goods, the number of items selected and
/or the destination address indicated by the User during the purchase process. The User is always informed of the amount of shipping costs before concluding the purchase procedure and making the payment.
Once the purchase is complete, the User must proceed with the payment, which will be made to Podere San Cristoforo.
Following a successful payment, the User will receive a confirmation email containing information about the offer purchased. The email will also contain a reference to these General Terms and Conditions.
The confirmation will contain a summary of the delivery and billing address. The shipment of the goods takes place within the time specified in the order confirmation.
The methods of payment accepted, unless otherwise specified or agreed with the User, are: credit card and prepaid cards of Visa, Mastercard, Maestro, Postepay, American Express, Discover (Diners Club International and Pulse), and PayPal accounts.
The charge of the sums due happens, unless otherwise specified in the terms of the offer, at the confirmation of payment.
If the User realizes that he/she has provided incorrect and/or incomplete information regarding his/her personal details or the shipping address of the goods, it is necessary that he/she communicate it promptly and within the terms of order dispatch, sending an email to
[email protected]. In all cases, the User is solely responsible for any indication of incorrect and/or incomplete delivery details or addresses, with the consequent possibility of losing the sum paid if the goods are delivered to outsiders.
Security in transactions
Podere San Cristoforo takes care of the safety of its Users.
Podere San Cristoforo does not process and does not retain payment details (eg: credit card numbers), which are processed and/or stored by the relevant payment service providers. Actual payment takes place through filling fields for entering protected and encrypted payment data, served directly by the banking service. Only after the transaction has been completed, the banking service provider informs Podere San Cristoforo of the outcome of the payment, without providing any sensitive information. For this reason, Podere San Cristoforo has no power over the possible rejection of the credit card used for payment. Podere San Cristoforo can not therefore be held responsible in any way for direct or indirect consequences resulting from the use of the credit card by the user to make the payment of the products and/or services purchased.
Shipping and delivery
The goods are shipped within the maximum time indicated in the terms of the offer. In any case Podere San Cristoforo, unless otherwise specified on the product sheet, undertakes to deliver the goods within 10 working days from the order date. In the remote case in which the goods become unavailable for any reason after receipt of the order, a refund of the payment received, will be issued, without expenses for the User. The User can be informed by email of the time when the product is shipped from the logistics of Podere San Cristoforo, or directly from the Partner who will inform Podere San Cristoforo of the shipment.
The User will be notified, if available, with the name of the courier and the tracking code of the shipment, through which it will be possible to follow the status. This information, if available, will also be visible within the User Account.
It is not possible to guarantee a specific delivery date or time as this depends on the carrier, the destination address and the person responsible for delivery. Podere San Cristoforo can not therefore be held responsible for any direct or indirect consequence deriving from these times. The delivery of what is ordered means, unless otherwise specified during the purchase process, on the street level.
In the case of shipping bottles, Podere San Cristoforo uses patented packaging and approved by the courier, designed to ensure the integrity of the product. In any case, at the time of delivery of the goods by the courier, the user will be required to verify that the packaging is intact, undamaged, or otherwise altered, even in the closing materials (adhesive tape or strapping) or that no liquid leaks. Any damage to the packaging and / or the product must be immediately contested by the User, subject to written control reserve (and specifying the reason for the reserve, eg “Pocketing”, “Crushed packaging”, etc.) on the document courier delivery. Once this document is signed, the User will no longer be able to make any objection regarding the characteristics of the goods delivered. Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 3 days of delivery, by writing an email to

In case of failure to deliver the goods within the indicated times, the User will be obliged to notify Podere San Cristoforo, who will check with the courier, the status of the shipment and any anomaly. Following a shipping anomaly (for example parcel that has been lost or destroyed during transport), Podere San Cristoforo will send the product again, subject to the availability of the product in stock, without further expenses or aggravations for the user, or otherwise, to fully refund the order or sending alternative product of equal value at User’s discretion.
Guarantee of conformity of the product
Podere San Cristoforo operates diligently and in absolute good faith in supplying products in the quantities and according to the characteristics described in the purchase offers.
The User is aware that the images used on the proposals may sometimes only be indicative of the product and not always represent the delivered product faithfully. Podere San Cristoforo will be responsible for the conformity of the products under warranty. Any complaints must be sent directly to Podere San Cristoforo via email to

Podere San Cristoforo will indicate the procedures for verification, replacement of the goods, or to issue a refund in favor of the User.
In any case, the legal guarantee is reserved for consumers or those who have made a purchase on Podere San Cristoforo for purposes unrelated to business, commercial, craft or professional activity carried out.
Withdrawal
The User requesting a service for purposes unrelated to his professional activity has the right to withdraw from the purchase contract concluded with Podere San Cristoforo without any penalty and without giving any reason, within 14 working days pursuant to and for the effects of art. 52 paragraph 1 of the Consumer Code, which start from the day of receipt of the product purchased on Podere San Cristoforo . The withdrawal may be exercised by the Customer, pursuant to art. 54 paragraph 1 Consumer Code, using the withdrawal form referred to in Annex I, part B of the Consumer Code or using the one available at the link: content/right-withdrawal or by presenting any other explicit declaration of its decision to withdraw from contract, to be sent or by letter a/r, to Podere San Cristoforo s.s. agricola, with head-office in Vicenza, Strada Marosticana 6/8 or via email at
[email protected] and to the Partner’s e-mail address indicated on the purchase confirmation page and also present in the User Account, also including Podere San Cristoforo. The letter a/r, the email must contain the indication of the product and the order number. The burden of proof relating to the correct exercise of the right of withdrawal, in accordance with the procedure indicated above, is borne by the User.
Following the correct exercise of the withdrawal-right, unless Podere San Cristoforo does not collect the goods directly, the User will have the responsibility to return the goods without undue delay and in any case within 14 days from the date on which the User has communicated to Podere San Cristoforo its decision to withdraw from the contract pursuant to art. 54, c. 4.
The User must apply, on the packaging and in a visible manner, the document received from Podere San Cristoforo following the withdrawal notice above, in which the shipping address and the order details needed to identify the order, are already indicated.
The User is advised to insert a copy of this document even inside the packaging, in order to avoid loss or the impossibility of identifying the return once it has arrived in stock. The relative shipping costs of the goods will be charged to the User, except in the case in which Podere San Cristoforo has not informed the client in this regard at the conclusion of the contract, in accordance with art. 57 paragraph 1 of the Consumer Code.
Podere San Cristoforo reserves the right to verify that the goods, of which the User is solely responsible pursuant to art. 57 paragraph 2 of the Consumer Code, are in the same state in which were delivered or that the products have not been altered in their essential and qualitative characteristics and keeps, as far as possible, their original packaging and label. In the event that this is not available, the User will be required to return the product appropriately packed, in order to preserve its integrity. Podere San Cristoforo can refuse to accept a withdrawal for food products that have been partially consumed.
Pursuant to art. 59 of the aforementioned Consumer Code are excluded from the possibility of withdrawal the goods made to measure or customized or that, by their nature, can not be returned or are subject to rapid alteration or deterioration.
Exceptions to the right of withdrawal
In any case it is understood that, with reference to the service, the right of withdrawal can not be exercised by the User after the complete supply of products by Podere San Cristoforo if the supply itself has started with the express agreement of the User and he has accepted to lose the right of withdrawal following the full execution of the service by Podere San Cristoforo.
In any case, pursuant to art. 59 of the Consumer Code, goods that are tailor-made or customized or which, by their nature, can not be returned or are subject to rapid alteration or deterioration are excluded from the possibility of withdrawal.
Refunds
The eventual refund of the sums by Podere San Cristoforo, if due, will take place pursuant to article 56 paragraph 1 of the Consumer Code in the shortest possible time, and in any case no later than 14 days from the date that gave rise to the refund and in the event of withdrawal, from the day on which it became aware of the related exercise by the User .
Podere San Cristoforo will refund using the same method of payment used by the User for the initial transaction, unless otherwise agreed with the User and on the condition that it does not incur any cost as a consequence of the use of the different method of payment. Podere San Cristoforo will not be required to refund delivery costs if the user has expressly opted for a different type of delivery that is more expensive than that offered by Podere San Cristoforo. It is understood that, with the exception of cases in which Podere San Cristoforo has decided to collect the goods directly, Podere San Cristoforo may withhold the reimbursement until it has received the goods or until the User has demonstrated that he has returned the goods, depending what situation occurs first.
Responsibility of Podere San Cristoforo
Podere San Cristoforo will not be liable for damages that may result from the use of the Site such as computer viruses, omissions, service interruptions and software failures, even to the detriment of the User’s computer equipment, which prevent or delay the provision of services if these are due to external causes, force majeure and/or third parties not dependent on the will of the owner.
For any defects or discrepancies found in the Sales, the User will be solely responsible for the User. Consequently, the User is informed that in such situations he will have to address his complaints and act towards Podere San Cristoforo. In any case, Podere San Cristoforo can not in any case be held responsible for delays or defects due to events beyond their reasonable control, such as, but not limited to: (i) events of force majeure; (ii) events due to third parties such as the interruption or malfunction of the services of telecommunications operators and/or power lines, or acts or omissions on the part of carriers or shippers.
Industrial and intellectual properties
Notwithstanding the limitation on the use of the distinguishing marks of the Partners, Podere San Cristoforo is the holder of all rights related to the graphic and conceptual content of the Site, as well as the distinctive signs of its visibility. It is therefore forbidden to reproduce, even partially, the content and graphics of the Site, as well as the distinctive signs made visible in the same. Podere San Cristoforo is also the owner of the technological management platform of the Website.
Privacy
Personal data are collected and processed in order to follow up the User’s requests. Podere San Cristoforo guarantees its users to operate in compliance with the regulations on the processing of personal data, governed by the Privacy Code pursuant to Legislative Decree no. 196/2003. The privacy policy is to be considered an integral and substantial part of these General Conditions. The data controller is Podere San Cristoforo s.s. agricola. Any complaint must therefore be addressed to: Podere San Cristoforo s.s. agricola, Head-Office in Vicenza, Strada Marosticana 6/8 – Italy.
Cookies
For the proper functioning of the Site, the use of Cookies is necessary. Cookies are used to obtain information on the terminals, the operating system, the IP address and the type of browser in use, in order to offer the user a better browsing experience. This is generally statistical data, which does not contain sensitive information. It is possible to refuse the use of cookies by activating the option to disable them on the browser or on the device in use.

The Site may contain links, in the form of hyperlinks or banners, to external and third-party websites. Podere San Cristoforo does not exercise any control over these sites and assumes no responsibility for the accuracy, nature, quality and completeness of the information contained on third party websites. The content of these sites does not represent products, services or information of Podere San Cristoforo.
Conciliation procedure. Applicable law and competent court
These General Conditions will be regulated in every aspect by Italian law. For any dispute concerning the interpretation, execution and/or termination of the contract between the user and Podere San Cristoforo, the Parties acknowledge that the Judge of the place of residence or domicile of the User will be competent, if the same has to be considered a consumer basing on the applicable laws in force. However, if the User is a professional, the Court of the Podere San Cristoforo’s place of residence will be competent.
